More lenient laws and a host of changes in the fabric and attitude of modern society have been contributing factors to the phenomenon that more and more marriages fall apart each year. Society no longer frowns upon divorcees and there are now more children with parents that no longer live together than ever before. Divorcing can be a very complicated process, especially if the marriage lasted some years. Both partners normally have a stake in the assets and liabilities that they have accumulated over time and if there are children decisions regarding their future must be made. Uncontested cases, on the other hand, are often settled quickly. In such cases only one attorney is retained. The role of the attorney is to help the couple to privately reach agreement on all issues. He will then present the full agreement to the court and in most cases that agreement is immediately made an order of the court. The entire process is private and there are no court appearances.

Divorcing couples often involve an attorney from the word go, even if the case is not contested. This is often an unnecessary waste of money. If the couple communicates well and if there are no serious disagreements regarding the terms of the divorce they could save a substantial amount by coming to a private agreement before hiring an attorney. The attorney will then simply have to check the legality of the agreement before filing it.

Many couples opt for saving even more money by hiring a specially licensed counsellor rather than an attorney to manage the negotiation process. These counsellors often charge less than half the fees demanded by attorneys. This is a legal option but many critics warn that counsellors, even licensed ones, are not properly trained in all the intricate complexities of the various laws that are relevant when marriages are dissolved.

It is a sad fact that many marriages fail simply because small matters have been allowed to become big issues and because the partners fail to communicate with each other. Experts often urge couples to seek counselling before resorting to divorce. If counselling also fails the couple should at least try to end their marriage in an amicable manner.
