The Various Subjects Covered In Barwinners

In preparing the students for their bar exams, the following topics are handled at the Barwinners. The first topic is on tort. Tort is a wrong doing which is condemned by law. In bringing an action for tort, the following issues must be demonstrated by the complainant.

Under the tort law, some of the issues considered are the elements which are considered the existence of a tort action. For instance, the element that the plaintiff must show that the defendant was compelled by law to act in a particular way and he failed to do so. The other element is that the plaintiff must show that the defendant breached the law which he or she ought to uphold. The other element is that the plaintiff must also show that he suffered loss due to the breach of the duty by the defendant.

The other are is on contract law. Contract may be defined as an agreement between two people or two entities to undertake some duties with specific terms. One party undertakes to perform some duty while the other party undertakes to give the other one some value for having undertaken such duties.

Contract law therefore guides the way in which people enter into these agreement. Some of the things addressed in the contract law include the following. One party has to make an offer to the other one who is at liberty to accept it or not to accept depending on the terms which are pegged to the offer.

The parties or the entities must be of legal capacity to enter into such contract. The parties or the entities must also have the intention to create a legal relation. These are some of the elements of a valid contract as highlighted in the Barwinners.

The other subject is on criminal law. Criminal law is a group of laws which prohibits certain conducts which are harmful to others. In criminal law, there has to intention to do that conduct. The intention is what is used to consider whether a conviction can be secured or not.

Evidence law is another topic addressed. Evidence law is a set of rules and guidelines on how evidence is produced in a court of law. These rules provides for the way the accused person should produce evidence to establish his case in court. They also provides for the way the accused person can interrogate the evidence produced in proving his or her innocence. Evidence law is considered as procedural law which enables the application of the substantive law.

The other are covered is on constitutional law. Constitutional law may be defined as the supreme law of each country which clearly provides for the separation of power between different arms of the government. The constitution provides for the specific functions and powers of the executive, the judiciary as well as the legislator. These are some of the areas considers in the Barwinners as they form the basics of the bar exams. Students who under go through the preparation are having high chances of passing the exam.
